Nicko Falcis statement versus Kris Aquino allegations: "May utang pa siya sakin na aabot sa P20 million for my "unpaid commissions".

Sino nga ba si Nicko Falcis? Paano sila nagkakakilala ni Kris Aquino? Ang lahat ng yan ay nakasaad sa counter affidavit na isinumite ni Falcis sa siyudad ng Pasig at Taguig noong Disyembre 17, 2018 laban sa reklamo ni Kris na 44 beses siyang dinaya at ninakawan ng kanyang managing director.

“I was told that Aquino wanted to meet me and explore the possibility of engaging my services in connection with her career as an entertainer and product endorser.” 



Bread winner at talent agent

Si Nicko, ayon sa sariling affidavit, ay may ganitong credentials:

Isa siyang Certified Public Accountant.

May hawak siyang Masters of Science Joint Degree in Global Finance mula sa Hong Kong University of Science and Technology Business School at sa New York University Stern School of Business.

Siya ay naging iskolar sa kinikilalang premier state university ng bansa, ang University of the Philippines sa Diliman, kung saan graduate siya ng Bachelor of Science Degree in Business Administration and Accountancy, cum laude.

Isa rin siyang Senior Lecturer sa UP Cesar E.A. Virata School of Business.



Chief Marketing Officer siya ng CINCO Corporation, isang personal financial adviser ng ilang katao, at franchiser ng walong sangay ng Potato Corner.

Sa kanyang bakanteng oras, ibinabahagi raw ni Nicko sa iba ang kanyang kaalaman tungkol sa “livelihood, online media, non-commercial endeavors, and personal advocacies.”

Pagpapakilala pa ni Nicko sa sarili, “I come from humble beginnings, was raised to be a decent, law-abiding person and was taught to always give every man his due, be honest and deal with people in good faith.”

Nagtrabaho si Nicko bilang talent agent ni Kris sa loob ng 18 buwan o isa’t kalahating taon.



Noong April 6, 2017, inatasan daw ni Kris si Nicko na kumuha ng endorsement contracts para sa TV host-actress at para sa KCAP.

Tinulungan din daw ni Nicko si Kris sa paglunsad ng career nito sa digital media.



Sa sariling salita ni Nicko: “I formulated a viable and profitable strategy for social media as her platform.

Pagpapatuloy ni Nicko sa kanyang Counter-Affidavit, kailangan daw ni Kris ng isang talent agent na gamay ang online media.

Ito ay dahil hindi na nakakontrata si Kris sa ABS-CBN bilang TV talent, at wala na siyang regular na TV exposure.

Ang layunin daw ni Nicko ay muling buhayin ang career ni Kris.

Upang maisakatuparan ito, ayon kay Nicko: “I met with representatives of prospective brands and businesses, I contacted brand agents and persuaded them to consider Aquino as their brand endorser, negotiated Aquino’s contracts and secured for her the best possible terms, discussed the draft contracts with Aquino and referred the drafts to her legal counsel for their review and approval, and, thereafter, finalized the contracts."

Liban dito, tiniyak din daw ni Nicko na protektado si Kris, “I would also make sure that Aquino, and the brands and businesses, complied with the terms of their contracts.”

Nagbunga naman daw nang maganda ang efforts nito.



Kris Aquino may utang na loob at malaki ang utang kay Nicko 

Sa kabuuan daw, ang kinita mula sa brand deals na ipinasok ni Nicko ay umabot sa P111,650,000, at inaasahang aabot sa mahigit P200,000,000 ang kikitain ni Kris sa pagtatapos ng 2018.

Sa loob ng 18 buwan nang pagtatrabaho niya bilang talent agent ni Kris, nakapagsara raw si Nicko ng maraming kontrata para sa aktres.

Sa kasalukuyan ay mayroong 50 brands na nakakabit sa pangalan ni Kris, na itinuturing na “one of the most popular brand endorsers in the country.”

Dahil dito, ayon kay Nicko, nalampasan ng kita ng KCAP ang kinita ni Kris bilang TV talent sa magkahambing na panahon.

“I transformed KCAP into a savvy media agency for brands to better appreciate Aquino specially in sealing brand endorsements and deals. 

“I created a very strong business model for entertainment and advertisement, to promote Aquino as a ‘millennial mom’ and ideal brand endorser or advertising model. 

“I led a team to produce great digital content and a unique business model that was very attractive to brands and businesses.”

Sa simula pa lang ng kanilang professional relationship ay walang hawak na kontrata si Falcis dahil pamilya ang turing niya kay Kris. 

“My professional association with Aquino is called an agency.

“At the outset, Aquino and I did not have a written contract covering her engagement of my services as her talent agent.

“Our agreement was oral but as binding as if it had been reduced to writing.”



Sa bawat endorsement contract o talent contract na naisasara ni Nicko, binabayaran daw siya ni Kris ng commission sa talent-agent rate na 12 percent ng halagang nakasaad sa kontrata. 

Nakukuha raw ni Nicko ang kanyang komisyon sa pamamagitan ng tseke, humigit-kumulang tatlong linggo pagkatapos ng contract signing at pagkatapos bayaran ng isang brand si Kris.

Ngunit base raw sa record ni Nicko, mayroon pa siyang hindi nakokolektang komisyon mula kay Kris, hanggang sa August 2018, na nagkakahalaga ng PHP800,000.

Bukod dito, mayroon pa raw siyang unpaid commission na nakatakdang dumating noong katapusan ng September 2018.

Sa pagkakaalam ni Nicko, ang hindi pa niya nakokolektang pera mula kay Kris ay umaabot na sa P20 million.

Mapapatunayan daw ito sa records na nasa pangangalaga ni Kris.
